Under the Women’s Health and Cancer Rights Act of 1998 (WHCRA), if your health insurance plan covers a mastectomy surgery the plan must also provide coverage for breast reconstruction surgery and other post mastectomy benefits. This includes coverage for:

All stages of your breast reconstruction

Surgery on the other breast to produce a symmetrical appearance

Breast prostheses

Treatment of complications from the mastectomy, including treatment of lymphedema
These rights extend to women who do not have breast cancer and are having a prophylactic mastectomy.
The Genetic Information Nondiscrimination ACT of 2008 (GINA) is a federal law that prohibits discrimination in health coverage and employment based on your or your family members genetic information. This includes basing eligibility or adjusting premiums based on genetic information.
